In a Multi-Car crash – Who Pays for the Damage?

Who pays for the damage caused in a multi-car collision depends on who was responsible for the crash. If one driver bears 100% fault for the accident, then that driver is 100% liable for everyone's injury and property damage claims. If more than one driver was at fault, then all at-fault drivers share liability for the damages, based on each of the at-fault driver's percentage of fault.

If one driver bears 100% fault for the accident, and multiple people were injured or killed, the question is: does the at-fault driver have enough insurance to cover everyone's injury claims? For this accident, if it is ultimately determined that Bruce Jenner bears 100% fault for the accident, there is a reasonable likelihood that he has sufficient insurance to cover all claims. Should his policy limit be insufficient, the injury victims or the family of the decedent can go after him personally.

If the at-fault driver does not have enough insurance to cover the value of the claims, an injury victim or his or her family can make an "underinsured motorist" claim under the injury victim's own auto insurance policy, provided that (1) the injury victim carries "uninsured motorist coverage" and (2) that the injury victim's uninsured motorist policy limit is greater than the at-fault driver's liability policy limit.
