Electric Scooter Class Action

McGee, Lerer & Associates and co-counsel Jeffery Costell of Costell & Cornelius have filed the first class action lawsuit against Bird and Lime electric scooters, and the scooters’ manufacturers. Included as plaintiffs in the lawsuit are injured riders and pedestrians. The legal causes of action include strict products liability, negligence, gross negligence, breach of implied warranty, and public nuisance. Also included is a cause of action for “aiding and abetting” assaults on the public, i.e., members of the public reasonably believed they were about to be touched in a harmful manner and the scooter companies aided and abetted this assault.
